Unfortunately, it is a fact of life that some non-custodial parents neglect their duty to provide support for their children. Federal law has mandated that the individual states maintain staff to assist custodial parents in enforcing child support orders. In the Commonwealth of Virginia, the Department of Child Support Enforcement (DCSE) has local staff and offices in Fairfax, Arlington, Fredericksburg and Manassas. The DCSE website is www.dss.state.va.us/division/childsupp/
In the past few years, clients have contacted our offices requesting assistance to extricate them from the clutches of unscrupulous collection companies. The collection companies advertise great success in collecting owed child support. However, these companies often require a significant initial fee, a large percentage of the amount collected, and execution by the client of a Power of Attorney assigning all collected fees to the collection company. Remember: “BUYER BEWARE!!”
We understand the frustration of the custodial parent when court ordered support payments are not forthcoming. We recommend that a parent either hire an attorney or contact the Virginia Department of Child Support Enforcement to assist him or her in collecting what is due the children.
